Acceptance of Orders

All orders are accepted by Proton Healthcare Ltd, subject to these conditions of sale. Orders will only be binding upon receipt of email confirmation from the payment acquirer, Proton Healthcare Ltd reserves the right to refuse any order. Should a pricing error occur within this website, within any fax or e-mail correspondence however received, all incomplete orders shall be deemed void.

Customer’s Authority

Customers, personal or agents for/on behalf of all other persons, entering into transactions with Proton Healthcare Ltd expressly warrant that they are authorised to accept and are accepting these conditions.

Payment

We accept payment through credit/debit cards. To pay via Cheque, please call our Free phone helpline, one of our advisors will be happy to take your order and provide you with an order reference number, a cheque should be sent to our office made payable to "Proton Healthcare Ltd" The order will dispatched upon clearance of funds. We accept cheques in Euros and £ Sterling.

For purchases from outside the Euro zone place your order and your credit card company or bank will convert the transaction to your own currency. Payment must be received in advance by credit/debit card when placing an order.

If we are unable to fulfil your order, we will inform you of the situation and you will not be charged, any money already paid by you for these goods will be refund. We are not liable for any financial loss incurred by you relating to interest payments, or loss of earnings, or similar gains you would have received on monies paid to us in lieu of an un-fulfilled order. All orders for goods are subject to stock availability.

Credit Card Security

Proton Healthcare Ltd uses a secure server for credit card payment. All credit card numbers are encrypted in the software when the order is placed using 128-bit encryption. They are only decrypted after they reach our computer. They are not held in clear text onour website and we do not have access to your card details.

Prices

All prices quoted or displayed are in GB Pounds and include VAT. Delivery charges, where applicable will be added during ‘checkout’ stage. Proton Healthcare Ltd reserves the right to make adjustments to the price to take account of any increase in, or the imposition of new taxes or duties. If due to an error or omission the price published for the goods on our website is incorrect, we have the right to terminate an order provided the goods have not been dispatched. We will try to ensure that all prices displayed on our website are accurate, but in the event of an error, we would inform you of the correct the opportunity to cancel the order will be given. Product Details and Specifications

Care has been taken to convey the exact details specifications of all Proton Healthcare Products, we do however reserve the right to alter details and specifications without notice explanation or notification.

Cancellation of an Order

Proton Healthcare Ltd reserves the right to cancel or amend any order, once accepted, without penalty. Cancellation by the customer, without penalty, will only be granted if the order is unprocessed. Where such cancellation or amendment is accepted it is on the understanding that a cancellation or amendment charge may be levied.

Back Orders
If your item is not in stock, we will back order it for you. You will be emailed with the option to cancel your order if this is not satisfactory.

Receipt of Goods should be signed for as “unexamined”. It is the responsibility of the recipient at the customers’ premises or on behalf of the customer to check that all boxes, quantities and goods that are delivered are as per the accompanying delivery note. Any damages or shortages must be reported immediately by phone and in writing within THREE working days of delivery, otherwise no claim will be considered. All packaging, in its entirety must be retained if pilfering is suspected or if breakage has occurred. Shortfalls cannot be rectified if these procedures are not strictly adhered to.

Force Majeure

Proton Healthcare Ltd is not be liable to you for any failure or delay in performance of our contract, if it is due to an event beyond our reasonable control including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing such obligations.

No Warranty

The descriptions and specifications of Goods are as supplied by the manufacturer. Proton Healthcare Ltd, its employees or agents are not authorised to make any representations concerning the goods unless confirmed in writing. In entering into this agreement you acknowledge that you do not rely on any such representation to complete your purchase with us. We make no warranty as the suitability of any goods for any particular purpose.

Deliveries
Every effort will be made to supply orders promptly. Proton Healthcare Ltd will not accept responsibility for suspension or delay in deliveries or for the consequences thereof. In general the price quoted is for delivery to the reception desk and/or ground floor at the stated delivery address where a signature will be required at the time of delivery.

Non-Delivery
Most orders are dispatched on a next working day basis. In the event of the non-arrival of goods to the stated delivery address, customers must inform Proton Healthcare Ltd within FIVE days of the original order date, otherwise no claim will be considered.

Proper Law

All contracts made with Proton Healthcare Ltd shall be governed by, and construed according to, the English Law and the purchaser submits to the jurisdiction of the English courts. These terms of trade will prevail over any conditions that shall be issued by the customer. The customer should not rely on any representations made by staff either verbal or written as they do not form part of the contract or collateral contract.

E&OE
Any typographical, clerical omissions or errors however made, in any of Proton Healthcare Ltd’s literature, quotations, price lists, invoices , other documents or information supplied by the company shall be subject to correction without any liability on the company's part.
